1. Who we are
Konquer Media Agency Pty Ltd (ABN 15 685 811 492) is the entity collecting your personal information. We're an Australian marketing agency based in Melbourne. We're bound by the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth).

2. What we collect
When you fill in our onboarding form, we collect:
- Your business legal name, ABN, and trading name
- Billing and content-approval contact names, email addresses, and phone numbers
- Tier selection and retainer preferences
- Technical metadata: IP address, browser user agent, time and date of submission
- Consent records (marketing opt-in, authority-to-bind acknowledgement, MSA acceptance)
If you proceed to payment, Stripe collects your payment-method details directly. Konquer never sees or stores your card numbers.
3. Why we collect it
- To set up your account and deliver the contracted services
- To issue compliant Australian tax invoices (Stripe Tax)
- To verify your ABN status via the Australian Business Register
- To meet Corporations Act (s.286) and ATO record-keeping obligations (7-year retention)
- To provide ongoing client communication during the engagement
- If you opt in: to send periodic marketing emails (separate consent)
4. Disclosees and overseas data transfers (APP 8)
We disclose limited personal information to the following third-party processors. Some are based overseas:
- Stripe (United States, Ireland) — payment processing, invoicing, Stripe Tax
- GoHighLevel (United States) — CRM and client communications
- Google (United States) — Drive folder provisioning, Calendar booking
- Cloudflare (United States, Australia) — hosting, DNS, anti-bot
- PandaDoc or Documenso (United States) — Media Services Agreement e-signature
- Australian Business Register (ABR) (Australia) — ABN validation
By submitting the form you consent to your data being transferred to these overseas processors. They each provide their own privacy notices and contractual protections.
5. How we store and protect it
- Data lives in Cloudflare D1 (encrypted at rest, region-restricted)
- Access is limited to Konquer team members on a need-to-know basis
- API secrets are stored in Cloudflare Wrangler secrets (encrypted)
- We retain personal information for the period required by Corporations Act (7 years post-engagement) and then it is destroyed or de-identified
6. Marketing communications (Spam Act 2003)
If you opt in to marketing emails, every email will identify the sender (Konquer Media Agency Pty Ltd, ABN, physical address) and contain a functional unsubscribe link. Unsubscribing is one-click, no login, and effective within 5 business days.
Transactional emails (invoices, contracts, account notifications) are sent regardless of marketing opt-in. They are not promotional and you cannot opt out of them while you remain a client.
7. Your rights (APP 12 + 13)
You can request:
- Access to the personal information we hold about you
- Correction of any inaccurate information
- Deletion (subject to our retention obligations under Corporations Act and ATO rules)
- A copy of this policy in another format

8. Complaints
If you believe we've breached an APP, contact us first at info@konquermediaagency.com. If unresolved, you can lodge a complaint with the Office of the Australian Information Commissioner at oaic.gov.au.
9. Notifiable data breaches (APP 11.3, Part IIIC)
If we suffer a data breach that's likely to cause serious harm, we'll notify affected individuals and the OAIC within 30 days, as required under the Notifiable Data Breaches scheme.
10. Changes to this policy
We may update this policy from time to time. The effective date at the top reflects the current version. Material changes will be communicated to active clients by email.
